Virginia law does not require that both parents consent to the name change, but obtaining a name change over the objections of a parent may be difficult: a judge will hold a hearing, consider the objections, and decide whether the name change is in the childs best interests.

In most cases, you must file a petition with your local court to change your name. To do so, you may need to file paperwork and appear before a judge to complete the process. Find your local government website and contact your circuit court to get information about how you can legally change your name.
Legal documentation showing the name change (i.e., a certified marriage certificate issued by a county court or a court order) along with an updated Social Security card showing your new legal name must be presented at a driver license center to record the name change and update your record.
Still, every state except Hawaii will provide you with a Court Order that can be used to make changes with your ID and Official Records. Because of Full Service, by EZ Name Change, California, Georgia and Illinois are considered among the easiest and surest ways to get a name legally changed.
In order to initiate a name change, a docHubd application prepared in ance with the Code of Virginia and Rules of the Virginia Supreme Court must be filed. The petitioner must also provide an order for consideration by the judge.
The filing fee for a name change is $44.00. Payments may be made by cash; check or money order made payable to Clerk of the Circuit Court; or by credit card (Visa, MasterCard or Discover). An additional 4% percent convenience fee applies to all credit card payments.
Adult Name Change When an adult wishes to legally change their name, a petition needs to be filed with the Court of Common Pleas; there is a filing fee of $333.23 that may be waived by the Court if you can prove you are low-income, however, there are usually publication fees that cannot be waived by the Court.
