California has enacted a new bereavement leave law under the California Family Rights Act, effective January 1, 2023. Employers with five or more employees must offer five days of bereavement leave to those who have been employed for at least 30 days prior. The definition of a family member includes domestic partners and extended family members. Employees may take this leave intermittently, but it must be completed within three months of the family member's death. While the leave can be unpaid, employers are not prohibited from having a paid bereavement policy.
