The Landlord and Tenant Act 1954, or the 54 Act, provides commercial tenants the right to remain in their premises even after their lease term ends, specifically for business use, not residential tenancies. If landlords wish to prevent tenants from having renewal rights, both parties can agree to contract out of these rights. This requires the landlord to serve a notice, the tenant to swear a declaration, and specific wording to be included in the lease. If a lease is contracted out of the 54 Act, different procedures apply once it expires.

Can you amend a lease agreement in Ontario?

During a lease term, both the landlord and tenant can propose amendments, provided theyre familiar with any rules in the Lease Agreement about changing the lease. Once both parties have agreed to the changes, they can be formalized with a Lease Amendment.
