Are Postnuptial Agreements Enforceable in New York? Yes, postnuptial agreements are generally enforceable. However, they must be executed in a manner that is consistent with state law. For example, the agreement must be in writing and must be signed by both parties.
In general, the California courts assume a prenuptial agreement is valid upon the date it is signed. The courts will assume a postnuptial agreement is invalid, however, until they decide otherwise. You and your spouse will need the courts to approve your postnuptial agreement for it to become valid.
Postnuptial agreements are invalid if it is determined that one of the parties exercised fraud, duress, or undue influence over the other. Fraud generally exists when one party deceived or concealed an important fact that would impact whether or not the other party executed the agreement.
Unlike for prenuptial agreements, in California we do not have any statute or case law which explicitly provides that a postnuptial agreement can include a waiver of spousal support. For any client that is contemplating a complete waiver of spousal support in their agreement, a premarital agreement is preferred.
A prenup is more likely to be enforceable than a postnup if one of the signers attempts to dispute it following dissolution of the union. Divorce courts tend to presume that coercion is less likely when independent people are signing before they are actually married and have mixed their assets.
A postnuptial agreement in New York is virtually the same as a prenuptial agreement, as they can cover the same ground. The only real difference is that a prenuptial agreement is entered into before the marriage and a postnuptial agreement is entered into after the couple is already married.
The New York Postnuptial Both parties must sign the document before a notary public and have legal representation as an option before completing this act. As with most other states, the postnuptial requires full transparency with a complete financial disclosure about all assets and debts currently in existence.
Section 1615 (c)(2)(B) of the California Family Code mandates that prenups executed after January 1, 2020, have at least seven calendar days between the time that party was first presented with the prenup in its final form and the time that the prenup is signed.
