Section 95 of the RTA applies to assignments of a rental unit by a tenant to another person. In the case of an assignment of a rental unit, the tenant must seek the consent of the landlord to the assignment. The request to assign may be either general or specific.
Assignment and subletting This section explains that the tenant needs the landlords permission to assign or sublet the unit to someone else, and that the landlord cannot arbitrarily or unreasonably withhold consent. This section cannot be changed.
You must ask your landlord for permission to assign. It is best to ask in writing and keep a copy of your request. Your landlord must answer within 7 days. If your landlord agrees to let you assign, they are allowed to charge you a fee.
In most cases the lease is transferrable with the consent of the landlord. However, some leases contain an absolute bar on assignment or underletting so it is important to review the relevant provisions within the lease, which will also detail the requirements of the landlord on any assignment or underletting.

If so, you may be allowed to assign or sublet your apartment to someone else under the Residential Tenancies Act, or to break your lease early if your landlord refuses to let you assign or sublet the apartment.
