The doctors note should start by describing the patient. This should include their full name, date of birth and any other identifying information. The doctor should then describe the condition of the patient. This may include a list of symptoms, as well as a brief description of the treatment plan.

Starting January 1, 2024, California employers will have to either front-load employees with 40 hours of sick time annually or let employees accrue up to 80 hours (with a 40-hour yearly usage cap).
A doctors note can be requested by an employer, but it should contain only necessary work-related information. Employee rights under HIPAA: Employees have a right to privacy regarding their medical information. If more detailed information is needed, the employer should obtain the employees consent.
What does my note need? Your note must contain a statement of medical necessity and list all of the specific services and items your doctor recommends. Your doctor needs to date the note because it will only be valid for one year (unless stated otherwise by your doctor).
Employees in California are most often not required to provide a doctors note to take paid sick leave. Therefore, it is clear that employers cannot deny an employee their right to use accrued sick days. The landscape of employment law is complex and constantly evolving.
