To be tenants in common you must be part of a tenancy in common agreement. A tenancy in common agreement is a situation in which 2 or more people hold interest in a property and each owner has the right to leave their share of the property to a beneficiary upon their death.
You can make this change without the other owners agreement. A solicitor, conveyancer or legal executive can also make the application for you.
If one owner dies, the property automatically passes to the other owner(s). Property owned in joint tenancy does not form part of your estate (because of the right of survivorship).
Create a Survivorship Affidavit to Remove a Deceased Owner A survivorship affidavit (sometimes called an affidavit of death or affidavit of continuous marriage) is a legal document used to remove a deceased owner from title to property by recording evidence of the deceased owners death in the land records.
An individual who owns a property as a joint tenant with another individual may unilaterally sever the joint tenancy by transferring their share of the property to someone else or by transferring their share to themselves. In Ontario, this would be completed by registering an entirely new transfer on Teraview.
Ownership as a group of individuals If a tenants-in-common co-owner dies, the ownership does not automatically go to other owners. Their share of property becomes part of their estate. If a joint tenant co-owner dies, surviving co-owners inherit the deceaseds share of the property.
You might be able to end your joint tenancy agreement straight away and get a new one just in your name. Your ex-partner and your landlord will need to agree to this change. This is called surrendering your tenancy. Before you ask your landlord to end your tenancy agreement, check if theyll agree to the change.
A joint tenancy may be converted to a tenancy-in-common by any joint tenant, unilaterally. This process is called severing the joint tenancy. The consent of the other joint tenant(s) is not required.
