You can have people go in and fill out a form, but they wont be able to edit the questions or the structure of the form. You can use things like check boxes, text fields, drop down lists, date pickers, to build your form. Once someones finished completing your form, they can e-mail it back, they could print it out, or you could even connect it to a database. Connecting to a database is outside of the scope of todays tutorial. Its kind of like an docHub PDF form, but its Microsofts version of it. At its most basic, a purchase agreement should include the following: Name and contact information for buyer and seller. The address of the property being sold. The price to be paid for the property. The date of transfer. Disclosures. Contingencies. Signatures.
The Supreme Court made clear that a purchase agreement that includes a buyer right to terminate for any reason prior to expiration of a contingency, due diligence, feasibility, or free look period is really an option agreement. Option agreements are unenforceable unless consideration is given for the option.
In order to be contractually enforceable, the option to purchase must be given in exchange for consideration, or value. While the value of an option contract cannot be nominal, there is no special floor or ceiling; its a matter of negotiation between landlord and tenant.
The basic elements required for the agreement to be a legally enforceable contract are: mutual assent, expressed by a valid offer and acceptance; adequate consideration; capacity; and legality. In some states, elements of consideration can be satisfied by a valid substitute.
An option contract has two elements: 1) the underlying contract which is not binding until accepted; and 2) the agreement to hold open to the optionee the opportunity to accept. In addition, an option contract requires consideration.
Option agreements are governed by contract law. They are legally enforceable as long as they follow the requirements for a valid contract. Contract laws vary by state and by subject matter of the contract.
Pay the balance deposit which is often 5% or 10% of the purchase price, less Option Fee. Buyers taking a home loan from a bank must have a Letter of Offer before they can exercise the OTP. The buyer has to pay the Option Exercise Fee to the seller.
If the buyer agrees to the terms within the designated time period, then a binding contract is created for the deal. The option expires at the end of the period stated in the contract, regardless of whether the buyer exercises the option.
