Title V is a federal program designed to standardize air quality permits and the permitting process for major sources of emissions across the country.
A Permit-by-Rule (PBR) is an optional permit provision in the Ohio Administrative Code (OAC) that applies only to a certain type of air pollution source or facility. The PBR contains qualifying criteria, emission limitations, conditions for operation and requirements for record-keeping and reporting.
New Source Review (NSR) is a Clean Air Act program that requires industrial facilities to modern pollution control equipment when they are built or when making a change that increases emissions docHubly.
A major source is defined as any emission point that emits at least 10 tons of any particular HAP per year, or more than 25 tons of any combination of HAPs per year. Title V Air also applies if your sources emit more than 50 tons per year of VOCs or Nitrogen Oxides.
Title V of the federal Clean Air Act reauthorization (1990) requires each state to develop a Permit-to-Operate system and emission fee program for major sources of air pollution. Ohios rules for this program became effective in April 1994. The Title V permit for major sources is enforceable by Ohio EPA and U.S. EPA.
The type of air permit most small businesses need is the permit- to- and operate (PTIO) from Ohio EPAs Division of Air Pollution Control (DAPC). The PTIO is required before installing and operating an air contaminant source. The PTIO lasts 5 to 10 years and is renewable.
Ohios permitting system currently is divided into two separate permits: the Permit To (PTI) and the Permit To Operate (PTO).
Title V Program. The Clean Air Act Amendments of 1990 (CAAA) require that each state develop a Title V operating permit program to permit major sources of air pollution and other sources subject to federal Clean Air Act requirements.
