By law, a health care provider, a hospital and other health care facilities must provide a copy of a patients health record upon the written request of the patient, his/her attorney, or authorized representative.
To obtain a copy of your medical record in Pennsylvania, start by asking your healthcare provider about their specific procedure. In most cases, youll need to fill out a form and then make a request in writing.
Most records are destroyed after a certain period of time. Generally most health and care records are kept for eight years after your last treatment.
The NYS Department of Health, however, requires medical doctors to retain records for any adult patients for 6 years. Minor patients are kept for 6 years and until one year after the minor docHubes the age of 18 (whichever is longer). For hospitals, medical records must be kept for six years from the date of discharge.
Unless specified otherwise herein, all parts of a medical record shall be retained for a period of seven (7) years from the last date of treatment, or, upon the death of the patient, for three (3) years. (a) Pathology Slides, EEG and ECG Tracings must each be kept for seven (7) years.
Electronic patient records (ERPs) must be stored for the foreseeable future. Maternity Records 25 years after the birth of the last child. Children and Young People until the patients 25th birthday or 8 years after their death. Mental Health Records 20 years or 8 years after their death.
In order to obtain your medical records, you should send a written request via certified mail to the last known address of the physician (you can find a physicians last known address on their Practitioner Profile).
Please submit your medical records requests in person, by mail, email or fax 203-432-1102 (see below for details). Once we receive your request we ask that you allow us 30 days to process your request, and we will contact you to arrange for pick up of your records.
