The landlord(s) or tenant(s) can sign the lease electronically if they both agree. The landlord must give a copy of the agreement to the tenant within 21 days after the tenant signs it. The standard form of lease must be used for most residential tenancy agreements (leases).
This form is a residential tenancy agreement (standard lease). Landlords of most private residential rental units must use this form (standard lease) when they enter into a tenancy with a tenant.
In Ontario, landlords are only allowed to request an upfront deposit for rent and keys. It is illegal for landlords to charge a damage deposit or a pet deposit. It is also illegal for landlords to require that you provide post-dated cheques.
However, a lease can be for any length of time, as long as both parties agree. It can be for 1 week, 4 months, 9 months, 3 years theres no minimum or maximum time period.
If they do not give you a standard lease, you can hold back one months rent. If they then give you the lease within 30 days after you held back rent, you must pay the money back.
If the landlord and tenant agree that the tenancy will last for a specific period of time, this is called a fixed term tenancy. This is because both the start and end date are set out in the tenancy agreement. Most leases are for a fixed term, usually for a year.
Landlords Obligations Regarding Lease Renewal Thus, the landlord is not obligated to offer a renewal of the lease for another fixed term. However, this does not mean the tenant must vacate the property at the end of the term, as their tenancy continues under the same terms and conditions, on a month-to-month basis.
In Ontario, unless planning consent is obtained or the lease covers only a portion of a building, a lease for a term of 21 years or more that only applies to a portion of the landlords real property is generally considered void.
