7. Everyone has the right to life, liberty and security of the person and the right not to be deprived thereof except in ance with the principles of fundamental justice. Section 7 guarantees the life, liberty and personal security of all Canadians.
Premier Francois Legault has said the entire bill is covered by the notwithstanding clause. A judge suspended two articles of that law in August, citing risks to access to justice, until the case can be heard on its merits. Quebec also used the clause in its religious symbols law.
The clause can only override certain sections of the charter — including Section 2 and sections 7 to 15, which deal with fundamental freedoms, legal rights and equality rights — but can't be used to override democratic rights. Once invoked, Section 33 prevents any judicial review of the legislation in question.
Section 24(2) obliges law enforcement authorities to respect the exigencies of the Charter and precludes improperly obtained evidence from being admitted when it impinges on the fairness of the trial (R. v. Burlingham, [1995] 2 S.C.R.
24 (1) Anyone whose rights or freedoms, as guaranteed by this Charter, have been infringed or denied may apply to a court of competent jurisdiction to obtain such remedy as the court considers appropriate and just in the circumstances.
The criminal justice system may be brought into disrepute by the admission of evidence that would deprive the accused of a fair hearing or from judicial condonation of unacceptable conduct by the authorities. Disrepute may also result from the exclusion of evidence.
