In seller financing, the property seller takes on the role of the lender. Instead of giving cash directly to the homebuyer, however, the seller extends enough credit for the purchase price of the home, minus any down payment. The buyer and seller sign a promissory note containing the loan terms.
The installment arrangement works like this: The contract states that the seller will keep title to the property until you pay off the loan. (You normally pay the loan off in a series of regular payments, similar to a standard mortgage.) After you do so, the seller signs a deed transferring title to you.
The buyer will likely have less negotiating power regarding the purchase price if the buyer requires seller financing to close the deal. The seller may even demand a higher purchase price if the seller is not going to receive the full purchase price at closing.
At the end of that period, a balloon payment is due. The expectation is usually that the initial seller-financed purchase will improve the buyers creditworthiness and allow them to accumulate equity in the home. Once that happens, they can then refinance their payment to the seller with a traditional lender.
Land Contracts, also known as Contracts For Deed, do not immediately transfer legal title to the buyer, who instead receives an equitable title. The seller will deliver the Deed conveying fee simple title to the buyer after the final payment is made toward the owner financed mortgage.
Cons Arrangements can be complex. Need to vet the buyer yourself. Lender might restrict owner financing options if seller still has a loan. Risk of loss if the buyer doesnt pay or damages the property.
The upsides for a seller: the ability to earn more from the buyers interest payments and to potentially unload the home as-is, without needing to make repairs. Additionally, sellers can obtain tax benefits by deferring any realized capital gains over many years, if they qualify, says McDermott.
In Owner Financing, Who Holds The Deed? Property ownership is equitable, but complete ownership doesnt transfer until the seller receives payment for the loan. Due to the deeds legal position, the seller holds it until the buyer pays off the loan.
