Many couples, especially those with two incomes, often have no choice but to sell their homes, pay off their loans and split the remaining money. Others opt to let one partner keep the property, often through a deed transfer and a reassignment or refinancing of the mortgage.
What Happens If Your Spouse Is Not On the Mortgage. If your spouse is not on the mortgage, they are not responsible for paying it. However, the mortgage lender can foreclose on the house if the mortgage is not paid.
What Happens if One Person Doesnt Want to Pay the Existing Mortgage? Even if one person doesnt want to or cant pay the mortgage, both people are likely still on the hook for the debt. After a divorce, if a woman keeps her married name, you can either use Mrs. or Ms. to address the guest followed by her first name and married name. If she is using her maiden name, then use Ms. along with her first name and maiden name.
Does It Matter Whose Name Is on the Mortgage in a Divorce? While the name on the mortgage can influence who is responsible for the debt, it doesnt necessarily dictate how the property is divided.
