okay Im not saying that this is going to happen to everyone but this is a great example about why you should always review your Severance with an attorney when a company offers you severance pay theyre not doing it to be nice they are doing it because once you take the money and sign the a severance agreement youve waived your right to sue them and most the time theyre betting that the severance theyre offering you is worth less than any legal claim you might have against them thats why its always important to talk to an experienced employment lawyer whenever you have a severance offer to make sure youre not leaving money on the table

The decision issued on February 21, 2023 by the NLRB restricts companies from demanding silence from laid-off employees through confidentiality, non-disclosure, and non-disparagement provisions in their severance agreements. What is this?
Violation of employment laws Severance agreements must comply with relevant employment laws such as anti-discrimination laws, wage and hour regulations and workers compensation provisions. An agreement containing provisions that contradict these laws may be considered invalid.
Severance pay is the greater of the following: 2 days wages, at the employees regular rate of wages, for each full year that an employee has worked for an employer before they were terminated, or. 5 days wages at the employees regular rate of wages.
58 (February 21, 2023), holding that certain confidentiality and non-disparagement provisions contained in employee severance agreements violate employees rights under the National Labor Relations Act (NLRA) and that the mere proffer of such provisions in a severance agreement is unlawful.
Your severance agreement may interfere with your future employment if it includes a non-compete provision, non-solicitation clause, clawback provision, cooperation requirement, or other terms.
For example, a severance contract could include a severance pay term granting one weeks pay for each year of service to the employer. Although not required, some employers may also offer other severance benefits, such as job counseling or payment of COBRA expenses, as part of an overall severance package.
A standard amount of severance is anywhere from 30 days to 6 months of salary. It mostly depends on your seniority and tenure at the company. Paying out cash is one of the hardest for a company to do. It may be easier to negotiate other benefits rather than money.
