Under the HIPAA Privacy Rule, a covered entity must disclose protected health information in only two situations: (a) to individuals (or their personal representatives) specifically when they request access to, or an accounting of disclosures of, their protected health information; and (b) to the Department of Health
In addition, two categories of information are expressly excluded from the right of access: Psychotherapy notes, which are the personal notes of a mental health care provider documenting or analyzing the contents of a counseling session, that are maintained separate from the rest of the patients medical record.
The exceptions include psychotherapy notes; information prepared in anticipation of litigation; information obtained under a promise of confidentiality; information which, if disclosed, is reasonably likely to endanger the patient or others; certain information about inmates; certain information about research subjects
Medical records are the document that explains all detail about the patients history, clinical findings, diagnostic test results, pre and postoperative care, patients progress and medication. If written correctly, notes will support the doctor about the correctness of treatment.
Acceptable identifiers may be the individuals name, an assigned identification number, telephone number, date of birth or other person-specific identifier. Use of a room number would NOT be considered an example of a unique patient identifier.
The access requested is reasonably likely to endanger the life or physical safety of the individual or another person. This ground for denial does not extend to concerns about psychological or emotional harm (e.g., concerns that the individual will not be able to understand the information or may be upset by it).
Emergency situation exceptions Treatment: Covered entities can disclose PHI necessary for treating the patient without authorization. Public health: Public health authorities and relevant parties can access necessary PHI to carry out public health missions without individual authorization.
1. You are a danger to yourself and threaten to harm yourself (e.g., suicidal). 2. You threaten to harm another specific person (e.g., assault, kill).
