Generally, an unmarried parent who has the care and control of the child is considered the sole custodian without having to go to court. This is usually the mother of the child. A court may order otherwise if there is a child custody case to be heard.
The other parent may or may not have rights of access and rights of decision making. When the other parent has rights of decision making, this is called joint legal custody. Sole maternal custody is the norm in Canada and most other countries for which there are data.
Shared custody surpasses joint custody by incorporating an equal or nearly equal distribution of time and responsibilities between both parents. Children in shared custody arrangements spend substantial time with each parent, often following a schedule that alternates between households at regular intervals.
