Yes. The model is protected by copyright law, even if you don't know who created it.
What is a Release Form Used For? Release forms are most used in the film, photography, documentary, music, and radio industries to ensure that any content captured by an entity is owned by them and not by the subjects that work with them on the project.
Names of both parties and whether they're giving or receiving permission to use the photo. Brief description of the images, the photographer, and the date. Details about the permission, including specific publishing methods allowed, naming conventions, etc. Spaces for signatures, printed names, and dates.
A model release is a written agreement between you and a person depicted in your image. By signing a model release, that person gives you (and other authorized users, like Adobe Stock customers) permission to publish the image or use it for commercial purposes.
When an image has copyright protection, no one else can use the image without the owner giving permission. With these rules in place, you need to assume that there is copyright attached to any image you come across. Otherwise, you may face a court order, fines, or escalated legal action.
To upload a model release with your content, attach a JPEG release no more than 20 MB in size using the + button next to “Releases” on the Submit Content page. Alternatively, you can take advantage of the Shutterstock digital release feature.
The agreement should also explain the ownership of the photos, the number of copies the client print, the usage of the photos whether commercially or non-commercially, and authorization if the photos can be uploaded online.
Information to include. While there's no exact template, include at least the following: Names of both parties and whether they're giving or receiving permission to use the photo. Brief description of the images, the photographer, and the date.
Generally speaking, the copyright belongs to the person who created the image – in the case of a photograph the person who took it (i.e. the photographer.) There are some exceptions to this – for example if the photographer is an employee (for example in a large studio) the copyright belongs to their employer.
It's important to always obtain a signed model release form prior to shooting, regardless of whether the model is paid or unpaid. Even if you don't have any plans to license the photos, an opportunity may present itself well after the shoot.
