Names of both parties and whether they're giving or receiving permission to use the photo. Brief description of the images, the photographer, and the date. Details about the permission, including specific publishing methods allowed, naming conventions, etc. Spaces for signatures, printed names, and dates.
A model release is a written agreement between you and a person depicted in your image. By signing a model release, that person gives you (and other authorized users, like Adobe Stock customers) permission to publish the image or use it for commercial purposes.
A photo release form — sometimes called a media release or consent form — is an agreement between a photographer and an individual (most often, the subject of the photo), which gives the photographer the right to commercialize the picture.
It's important to always obtain a signed model release form prior to shooting, regardless of whether the model is paid or unpaid. Even if you don't have any plans to license the photos, an opportunity may present itself well after the shoot.
When an image has copyright protection, no one else can use the image without the owner giving permission. With these rules in place, you need to assume that there is copyright attached to any image you come across. Otherwise, you may face a court order, fines, or escalated legal action.
Do photographs enjoy copyright protection? Yes, photographs are considered to be “artistic works” in the current federal law that governs copyright in Canada - the Copyright Act. As with any artistic work, copyright protection only extends to photographs that are both “original” and “fixed” in a tangible form.
A photo release form is a contract between the photographer and the entity that takes part in a photo. It's written permission that allows the photographer or another party to use the image. The agreement provides rights to publishing on various media platforms.
The agreement should also explain the ownership of the photos, the number of copies the client print, the usage of the photos whether commercially or non-commercially, and authorization if the photos can be uploaded online.
To be acceptable and legally relevant, the release must contain information about the photographer and the model, including mailing address and contact information (such as email and/or phone number, home address, etc.) and must be signed by both parties.
There should be something offered in return—called a consideration, in legal terms—so that the photo release is a fair, two-way street. Similarly, if you're signing over your rights to your images in a media release form, there should be some form of compensation.
