A general power of attorney grants broad powers to an agent. Essentially, the agent has the same authority as you have to make decisions, handle your financial affairs and manage your assets. One notable exception to this is that agents cannot gift money or property belonging to the principal to themselves.
One major downfall of a POA is the agent may act in ways or do things that the principal had not intended. There is no direct oversight of the agents activities by anyone other than you, the principal. This can lend a hand to situations such as elder financial abuse and/or fraud.
You can use Form 2848, Power of Attorney and Declaration of Representative for this purpose. Your signature on the Form 2848 allows the individual or individuals named to represent you before the IRS and to receive your tax information for the matter(s) and tax year(s)/period(s) specified on the Form 2848.
The IRS will accept a power of attorney other than Form 2848 provided the document satisfies the requirements for a power of attorney.
By law, IRS telephone assistors will only speak with the taxpayer or to the taxpayers legally designated representative. One of these forms, which is current, completed and signed: Form 8821, Tax Information Authorization. Form 2848, Power of Attorney and Declaration of Representative.
The process is automatic, including the verification of the good standing of the tax professional. Most requests post promptly (within 48 hours) to the CAF, eliminating long waits for review and processing.
You can grant a third party authorization to help you with federal tax matters. The third party can be a family member or friend, a tax professional, attorney or business, depending on the authorization.
The IRS will accept the broad DPOA as giving the attorney-in-fact the authority to execute a Form 2848 on behalf of the taxpayer. In this scenario, an attorney-in-fact wishing to initiate representation before the IRS should submit the broad DPOA and also complete Form 2848 with all relevant information.
