[Music] welcome to this week's okay at work with myself sarah sawyer and my colleague russell berger from the labor and employment group at off at kerman so this week we are talking about arbitration clauses in employment agreements so um sure a lot of folks are familiar with arbitration agreements generally and a lot of times you'll see them in different contracts service contracts employment contracts and you know kind of background is that with an arbitration clause instead of going and trying a case in court you try it in arbitration which is similar but different um it's you know an arbitrator oversees the proceedings and uh you know a lot of times it can be confidential and there's you know people have to pay for it there's different rules involved but recently uh house democrats just reintroduced a bill to ban workplace arbitration clauses um you know citing that the uh forcing employees into arbitration is unfair to employees and trying to get rid of those types of clauses um...

An arbitration agreement is to be treated as separate from the main agreement in which it is contained and, as such, survives the termination or invalidity of the main agreement—this is known as the 'doctrine of separability'.

A party seeking to compel arbitration must therefore show, as a threshold matter, that a valid and enforceable agreement to arbitrate exists. To do so, the three elements of a contract – offer, acceptance, and consideration – must be proven.
Standard Arbitration Clause International - Any controversy or claim arising out of or relating to this contract, or the breach thereof, shall be determined by arbitration administered by the International Centre for Dispute Resolution in ance with its International Arbitration Rules.
