hello everybody and welcome to uh this edition of uh ask alan the legal bulletin got a very interesting question today and that is are non-competes effective in a layoff and the short answer is yes uh and im gonna qualify that by saying a non-compete is as effective um in a layoff as it is in another situation um non-competes arent automatically effective theyre not automatically invalid it really depends on your particular situation now i think that every judge is going to take into consideration the fact that youve been laid off or that youre laying someone off as one of the equities to balance in it when deciding whether or not uh to enforce the non-compete very much a different situation uh if you have lets just say you have a sales person who leaves company a go into company b or maybe theyre going to start their own business and theyre going to try to take customers from their previous employer or theyre just going to compete for new customers um against the old employer
