Common types of custody arrangements include: Sole Custody. When a parent receives sole legal custody, they will have the exclusive ability to decide how to raise the child. Joint Custody. In a joint custody arrangement, both parents have custody rights to the child. Split Custody.
Joint Custody This means that both parents have equal responsibility for the child or children. They have to share the planning and decision making on schedules, where the kids go to school, what religion they are raised with, where they live.
The other parent may or may not have rights of access and rights of decision making. When the other parent has rights of decision making, this is called joint legal custody. Sole maternal custody is the norm in Canada and most other countries for which there are data.
The other parent usually will not want the parent who has custody to move to a distant place which makes regular visitation difficult or impossible. The Supreme Court of Canada has recently determined that a custodial parent cannot automatically move a child anywhere without the other parents consent.
If the parents share parenting time 50/50, each parent pays the tabled amount to the other parent. Effectively, this means the higher income earner pays the lower income earner the difference between the two tabled amounts.
As stated previously, both parents are equally entitled to care and custody of the child. However, practically speaking, where there is no court order, the parent with whom the child resides has de facto custody of the child and has the right to make all day-to-day decisions with respect to the child.
Close to 80 percent of children under the age of 12 were placed in their mothers custody in cases where a court order existed. Almost 7 percent were placed in their fathers custody, and for 13 percent of children, a shared custody arrangement was established.
Shared custody surpasses joint custody by incorporating an equal or nearly equal distribution of time and responsibilities between both parents. Children in shared custody arrangements spend substantial time with each parent, often following a schedule that alternates between households at regular intervals.
