So who owns a patent/patent application? In the US, the inventor is presumed to be the initial owner of a patent or patent application.
If after filing an application for patent, the applicant assigns the rights of his invention by written assignment or agreement to some other person, then that person (the claimant) may make an application, in Form 6 (sample Form 6, pasted below) along with a fee of Rs.
To transfer patent ownership to a company or another entity, each inventor must sign a document called a patent assignment which should then be recorded with the USPTO. First-time patent clients sometimes hesitate to identify inventors, especially when the principals of the company are not the inventors.
The length of the examiners queue, the complexity of your invention, and the type of application you have filed will determine your wait length. For a nonprovisional application, the average time for a review from the Patent Examiner is 21 months, and the average wait to receive a patent as a whole is 32 months.
In most countries, if an employee has developed an invention in execution of his/her employment contract i.e. usually during his/her working time within the enterprise the invention (and the related patent rights) will belong to the enterprise.
There are three types of patents: utility, design and plant. Utility and plant patent applications can be provisional and nonprovisional. Provisional applications may not be filed for design inventions.
When an inventor obtains a patent, they secure the right to exclude others from using, making and selling their product or method of use for 20 years, while maintaining the right to sell the item exclusively and for a higher price.
