Fill out a Redetermination Request Form [PDF, 100 KB] and send it to the company that handles claims for Medicare. Their address is listed in the Appeals Information section of the MSN. Or, send a written request to company that handles claims for Medicare to the address on the MSN.
The 5 Levels of the Appeals Process.
First Level of Appeal: Redetermination by a Medicare Administrative Contractor (MAC) Second Level of Appeal: Reconsideration by a Qualified Independent Contractor (QIC) Third Level of Appeal: Decision by the Office of Medicare Hearings and Appeals (OMHA) Fourth Level of Appeal: Review by the Medicare Appeals Council.
The first level of an appeal for Original Medicare is called a redetermination. A redetermination is performed by the same contractor that processed your Medicare claim. However, the individual that performs the appeal is not the same individual that processed your claim.
Grievance: Concerns that do not involve an initial determination (i.e. Accessibility/Timeliness of appointments, Quality of Service, MA Staff, etc.) Appeal: Written disputes or concerns about initial determinations; primarily concerns related to denial of services or payment for services.
An appeal is when someone who loses a case in a trial court asks a higher court (the appellate court) to review the trial courts decision. In almost all cases, the appellate court ONLY looks at two things: Whether a LEGAL mistake was made in the trial court; AND.
There are 3 stages in the appeals procedure and each stage must be followed through before proceeding to the next one.
Second Level of Appeal: Reconsideration by a Qualified Independent Contractor. Any party to the redetermination that is dissatisfied with the decision may request a reconsideration.
