So, um, for those of you who dont know, actually I take that back, Ill start from the very, very beginning. So when somebody passes away either by natural causes or by accident, you know, victim of violent crime, etc., they generally will have to have their affairs winded or wound up, I guess. Not all assets are subject to probate in Texas.Non-probate assets often involve the following accounts: Bank Accounts. Investment Accounts. Retirement Accounts (IRAs Pension Plans) Life Insurance Policies. Annuity Contracts. Real Estate. Vehicles.
Real or personal property that the person who died owned with someone else (joint tenancy) Property (community, quasi-community, or separate) that passed directly to the surviving spouse or domestic partner. Life insurance, death benefits, or other assets not subject to probate that pass directly to the beneficiaries.
The form must be docHubd, so make sure you dont sign it until you can do so in the presence of a notary public. Youll also need to attach a copy of the death certificate and a certified copy of the will if there is one.
One way is to set up a small estate affidavit. This document allows the executor of the estate to collect and distribute the assets without having to go through probate court. Another way to avoid probate is to set up a pay-on-death account for your assets.
Illinois law says a small estate affidavit needs to state the following: The name and address of the affiant, which is the person swearing out the affidavit who hopes to collect the assets from the estate, The name of the decedent, which is the person who died, The date and location of the death,
Exempt Assets-- Items such as a vehicle, home furnishings, tools and livestock. Non-Exempt Assets-- Assets that are not exempt, such as ordinary bank accounts. If there is no real property and just other assets, heirs are generally able to go forward with a Small Estate Afiidavit.

Any estate with probate assets exceeding $100,000.00 must go through the formal probate process. Additionally, Probate is typically required in Illinois when the probate assets contain real estate.
Not all estates must go through formal probate in Illinois. It is possible to have a small estate affidavit if the estate is worth less than $100,000 and there is no real estate involved. Instead of filing formal probate, the person who is the heir will use an affidavit to claim the estate.
Since the affidavit does not need to be filed with the court, there are no filing or court fees. The only cost is likely to be paying to have signatures docHubd.
