A Living Trust is not a requirement in the state of California. However, if you are a California resident, setting up a Living Trust can offer many advantages.
Signing Your Trust Document in Front of a Notary (In Florida, two witnesses are required; a witness statement automatically prints out with the Florida trust document.) But you do need to sign your living trust document in front of a notary public for your state.
Section 736.0412, Florida Statutes, provides that an irrevocable trust can be terminated without court approval if the trustee and all “qualified beneficiaries” unanimously agree to do so. The process is referred to as “nonjudicial termination” of trust, and is permissible for only certain trusts.
(1) Upon the death of a settlor of a trust described in s. 733.707(3), the trustee must file a notice of trust with the court of the county of the settlor's domicile and the court having jurisdiction of the settlor's estate.
One of the great benefits of a living revocable trust is that it is private and confidential – it does not need to become a public record; it does not need to be recorded, registered or filed. This is just one reason why a living trust has become the preferred planning legal instrument for most persons.
How to Set Up a Living Trust in Florida Choose between a single trust or a joint trust for married couples. Pick a successor trustee to take over upon your death. Determine who will benefit from the trust after you've died. Draft the trust document. Formally execute the trust document with two witnesses and a notary.
Trusts aren't recorded anywhere, so you can't go to the County Recorder's office in the courthouse to ask to see a copy of the trust. However, if real estate is involved, the trust may be recorded in the local office of the county clerk.
With an irrevocable trust, the transfer of assets is permanent. So once the trust is created and assets are transferred, they generally can't be taken out again. You can still act as the trustee but you'd be limited to withdrawing money only on an as-needed basis to cover necessary expenses.
Rule of Perpetuities. In common law, the Rule of Perpetuities states that nothing can last forever. ing to this rule, a trust can remain open up to 21 years after the death of the last person who was alive at the time the trust was made.
A trust may also be set up by a will, which leaves property in trust for a beneficiary. These trusts are called testamentary trusts and are usually irrevocable. Trusts are not filed or registered with the Court.
