The general principle is that a contract made by a minor with an adult is binding on the adult but not on the minor, including when the person reaches the age of majority.
Exceptions to Creating a Binding Contract with a Minor Any contracts for necessities, such as services and goods that are necessary to the safety and health of minors, can't be voided at will. Examples of necessities include shelter or lodging, clothing, and food.
Generally, if a minor makes a contract, the minor has the ability to void the contract until they reach the age of majority. Protecting minors from the consequences of entering into an agreement they do not understand is the purpose of this rule.
In general terms, adults of sound mind have full contractual capacity and are free to enter into such agreements as they wish1. Minors (those under the age of 18) do not have full capacity to enter into agreements.
If a minor agrees to a contract without a legal guardian being party to the contract, the guardian may not be held liable if the minor does not keep up his or her end of the agreement. However, if a parent or legal guardian co-signs the contract with the minor, the contract is considered valid and legally binding.
Generally, only individuals with legal capacity can enter into a contract. This means that minors, persons of unsound mind, and persons deprived of civil rights are not capable of contracting. (Civil Code section 1556.)
Although 18 years is the legal contract age in most states, there are several exceptions—such as the case of emancipation. If the minor hasn't reached the legal contract age but is granted legal status by a court of law, he/she may enter into contracts.
Minors (those under the age of 18, in most states) lack the capacity to make a contract. So a minor who signs a contract can either honor the deal or void the contract. There are a few exceptions, however. For example, in most states, a minor cannot void a contract for necessities like food, clothing, and lodging.
3 Minors' Contracts Act 1987. You can enter contracts at 18, this means you can make binding contracts in your own right. You can own land, buy a house or flat, hold a tenancy or apply for a mortgage.
With certain exceptions, anyone 18 years of age or over can enter into a contract. People under the age of 18 do not have the same full contracting power that adults do. They can still make contracts, but there are special rules.
