The HIPAA release form should have the following core elements: A depiction of the PHI. The reason why the PHI will be shared or utilized. The name or other specific identifier of the individual or entity who will receive the PHI. The name or other specific identifier of the individual or entity giving the authorization.
Examples of PHI include: Address (including subdivisions smaller than state such as street address, city, county, or zip code)
The 18 PHI identifiers Patient names. Geographical elements. Dates related to the health or identity of individuals. Telephone numbers. Fax numbers. Email addresses. Social security numbers. Medical record numbers.
What is not considered PHI? Identifying information, such as personal names, residential addresses, or phone numbers, is not considered PHI unless it is related to health data. For instance, names, addresses, and phone numbers listed in a phone book is not considered PHI because it is not related to heath data.
The Health Insurance Portability and Accountability Act of 1996 (HIPAA) regulations established national privacy standards for health care information. HIPAA prohibits the release of information without authorization from the patient except in the specific situations identified in the regulations.
The purpose for which the information will be disclosed. The name of the person or entity to whom the information will be disclosed. An expiration date or expiration event when consent to use/disclose the information is withdrawn. For example, an expiration event may be when a research study is completed.
As weve talked about before, personal identifiers combined with health information constitute PHI. IP addresses are personal identifiers. So, if your tracking tool logs an IP address of a user and the page containing health information the visitor viewed, that combination is PHI. Thats a HIPAA violation.
Under HIPAA PHI is considered to be an individuals health, treatment, and payment information, and any further information maintained in the same designated record set that could identify the individual or be used with other information in the record set to identify the individual.
