42 CFR Part 2 (Part 2) is a federal regulation that requires substance abuse disorder treatment providers to observe privacy and confidentiality restrictions with respect to patient records. The HIPAA Privacy Rule also limits use and disclosures of information found in patient records.
Part 2 requires each disclosure made with written patient consent to be accompanied by a written statement that the information disclosed is protected by federal law and that the recipient cannot make any further disclosure of it unless permitted by the regulations (42 CFR 2.32).
How do I know if Part 2 applies to me? by a federal office or agency, receipt of any federal funding, or registration to dispense controlled substances related to the treatment of SUDs. Many SUD treatment programs are federally assisted.
Title 42 of the Code of Federal Regulations (CFR) Part 2: Confidentiality of Substance Use Disorder Patient Records (Part 2) was first promulgated in 1975 to address concerns about the potential use of Substance Use Disorder (SUD) information in non-treatment based settings such as administrative or criminal hearings
Under 42 CFR 2.31, a Part 2 consent form must list the date, event, or condition upon which the consent will expire, if not revoked before. Thus, it is not sufficient under Part 2 for a consent form to merely state that that disclosures will be permitted until the consent is revoked by the patient.
There are a few limited exceptions when providers can make disclosures without a patients written consent, including: Internal communications. Medical emergencies. Reports of alleged child abuse or neglect (if required by state law)
The 42 CFR Part 2 regulations (Part 2) serve to protect patient records created by federally assisted programs for the treatment of substance use disorders (SUD).
The regulations at 42 CFR part 2 (Part 2) protect the confidentiality of substance use disorder (SUD) treatment records.
