Hello, everyone. My name is Edward and I am a patent examiner at the USPTO. I will be providing a demonstration today on the Patent Public Search tool with an emphasis for design searching and examination. Ill also be using the abbreviation abbreviation PPUBS to refer to this tool. So lets go ahead and get started. I will go ahead and share my screen. So there are a couple different ways you can access this tool. The first is via a direct hyperlink, which well include in the notes of this video. A provisional patent application is not an actual patent. A provisional patent application is a cheap and fast way to gain protection on an invention for 12 months and allows the inventor to test and perfect a concept prior to filing a full patent.
Color drawings are acceptable in US patent applications, but not in international applications (see PCT Rule 11.13). For utility applications, the following are required for submitting color drawings [see see 37 CFR 1.84(a)(2)]:
Though there is no mandate from the patent offices to include drawings as part of your provisional patent application, it is always advisable to supplement your application with drawings. This is because drawings not only describe your invention accurately but also broaden the scope of your invention.
The answer is YES! if a petition is granted explaining why the color drawings or photographs are necessary for illustrating the claimed invention. Under 35 U.S.C. 113, the Applicant for a patent must furnish a drawing where necessary for the understanding of the subject matter to be patented.
All lines in the drawings must, ordinarily, be drawn with the aid of a drafting instrument and must be executed in black, uniformly thick and well-defined lines. Color drawings are not acceptable. PCT Rules 11.10 to 11.13 contain detailed requirements as to further physical requirements of drawings.
If you file with photographs when drawings would have adequately depicted the subject matter; you could be required to convert the photographs to line art. When filing photographs, be sure to describe the images as photographs instead of drawings in the description. Photographs described as drawings could be rejected.
The website of the United States Patent and Trademark Office states that the text and drawings of a patent are typically not subject to copyright restrictions, and similar views have been published by patent attorneys.
Generally, you trademark an image by applying to the U.S. Patent and Trademark Office (USPTO) and getting your application approved for registration. Trademarking with the USPTO is a legal process that usually takes about 12 months. So, the sooner you start trademarking your image the better.
