Home Do I need a new EIN if I change from Sole Proprietor to LLC? Need to save time? Yes, if you have an existing Sole Proprietorship with an EIN and you want to change your Sole Proprietorship to an LLC, you will need a new EIN from the IRS. This is regardless of whether or not you have a DBA.
If you are planning to start a new business and the entity being formed is a Limited Liability Company (LLC) then you will need to apply for and obtain a new EIN.
If you have multiple businesses and they are not established as legally separate entities, you can use the same EIN for all of them, even if they have different trade names or DBA names. The IRS, which issues EINs, is a federal body, and trade and DBA names are a state matter.
Generally, businesses need a new EIN when their ownership or structure has changed. It is not possible to use the same EIN for different Entity types or for businesses that are not related.
The IRS asks that you send a letter, on company letterhead (if available) providing the name and Social Security Number of the owner(s) of the LLC. Be sure to include the LLCs complete name, EIN, and mailing address so the IRS can correctly identify your IRS account.
Can I use the same EIN for multiple businesses? If you have multiple businesses and they are not established as legally separate entities, you can use the same EIN for all of them, even if they have different trade names or DBA names.
Fill out form 1120S, and mark line H, box 2 on page 1 if you are an S corporation. If you have already filed your return for the current year, write to the IRS at the address where you filed your return and inform the agency of your new business. Include your EIN number and have a corporate officer sign the letter.
