Section 1006.34(b)(3) states that the itemization date is any one of five reference dates for which a debt collector can ascertain the amount of the debt. The reference dates are the last statement date, the charge-off date, the last payment date, the transaction date, and the judgment date.
What Is a Debt Verification Notice? Under the FDCPA, a collector must provide you with information about the debt in its initial communication or within five days after the initial communication, including: the amount of the debt. the name of the creditor to whom the debt is owed.
So, youll notice the FDCPA says the consumer must request validation of the debt or dispute the debt within 30 days or she automatically admits validity of the debt, but the collector can take however long they want to validate the debt.

If you didnt receive a debt validation letter, you can begin to build a case against the collection agency. The first step is to explicitly ask for a debt validation letter. The FDCPA makes it illegal for agencies to deny your request, so you could gain the right to sue the debt collector if they dont comply.
The debt validation letter includes: The amount owed. The name of the creditor seeking payment. A statement that the debt is assumed valid by the collector unless you dispute it within 30 days of the first contact.
What Happens If the Collector Does Not Verify the Debt? If a debt collector fails to verify the debt but continues to go after you for payment, you have the right to sue that debt collector in federal or state court. You might be able to get $1,000 per lawsuit, plus actual damages, attorneys fees, and court costs.
