What is a Lodger Agreement? A Lodger Agreement is a type of residential licence that sets out the terms under which a lodger can occupy the property where the landlord lives. Lodger Agreements are used by live-in landlords to rent out a spare room in their home. For use in England and Wales only.
I therefore hereby give you notice that I require you to vacate the room, premises, facilities you share with me and my home on or before [insert date]. It is important that you are made aware that after the above date has passed, I do not need a court order to obtain possession because you will be an excluded lodger.
You will need a licence for a shared house or flats where three or more people share facilities such as a kitchen or bathroom. The property must consist of two or more households. If there are two or more households and 5 or more people sharing facilities, you will require a mandatory licence.
In order to evict a lodger, the landlord only needs to give the lodger a written notice that is as long in length as the period of time that the lodger pays rent for. For example, if the lodger pays rent on a weekly basis, then the landlord only needs to give 7 days written notice to the lodger.
In law, a lodging arrangement is defined as a residential licence the lodger doesnt have exclusive use of the premises and shares the living space with the person letting the room (called the licensor). Lodgers who are licensees dont have the same rights in law as tenants.
