In Montana, the court system uses parenting plans to determine the custody of minor children, including when and where each parent will be with and responsible for each child. It also includes who is responsible for decision-making and provides for the financial care of the child.
In Montana, judges in divorce cases never let a child decide which parent they want to live with. However, when considering and determining a parenting plan that is in the best interest of the minor child, judges consider a variety of factors, which may include the wishes of the child.
Theres no set age in Montana at which a judge must give consideration to a childs preferences. Rather, the judge will look at the unique circumstances of each case. As a general rule, the older a child is, the better the chance of a judge taking the childs wishes into account.
Montana law outlines shared custody as any arrangement in which the child has regular and continuing contact with both parents. Shared physical custody is the most common form of custody awarded by family courts in Montana. Parenting time does not have to be equally divided to qualify for shared physical custody.
Generally speaking, Montana courts do not favor one gender of a parent over the other gender of the parent. The statute says that both parties should have the equal opportunity to parent their kids, or phrased another way, that children should be able to spend as much time with both parents as they can.
In the 2-2-3 schedule, children live with one parent for two days, spend the next two days with the other parent, and then return to the first parent for three days. The starting parent switches each week. And the alternating weeks schedule has your children spend one week with each parent.
