Filing a New York mechanics lien involves 3 steps: Fill out the proper NY mechanics lien form. New York law sets specific requirements for the form to use when filing a mechanics lien claim. Serve a copy of the lien on the property owner. Record the lien with the NY county recorder. File an Affidavit of Service.
If you work or provide material to a contractor or subcontractor of a public improvement project for the City, you can file a Notice of Lien. A lien is a legal claim against property for outstanding debt. You can file the notice before the project is completed or within thirty days of completion.
The fee for filing a notice of Mechanics Lien is $30.00. The fee for filing an Affidavit of service of Mechanics Liens is $5.00.
To file a judgment lien, an abstract of judgment (commonly called an AJ) must be recorded in the county where the real property is located or where property could be owned in the future. Rules for the issuance of an abstract of judgment can be found in Section 52.002 of the Texas Property Code.
Generally, a New York mechanics lien can be filed at any time during the progress of the project, but no later than 8 months of the completion of the contract or the last date of furnishing labor or materials.
