How is an Affidavit of Heirship Different Than Probate? An Affidavit of Heirship is not a formal adjudication like probate is. Rather, it is an affidavit outlining the deceased persons family history and the identity of heirs. Nothing is filed in the Probate Court.
The Heirship Affidavit need only be signed Page 2 and sworn by the disinterested parties. All signatures must be in the presence of a Notary Public. Clerk of the county of decedents residence, along with an Order for the Judge to sign approving it as conforming with the requirements of TPC 137.
The Affidavit of Heirship form you file must contain: The decedents date of death. The names and addresses of all witnesses. The relationships the witnesses had with the deceased. Details of the decedents marital history. Family history listing all the heirs and the percentage of the estate they may inherit.
In Texas, the spouse and children inherit first. Then further and more distant family members can inherit. Does an affidavit of heirship include bank accounts, and other financial assets? No, an affidavit of heirship is for property transfer only.
Where do you file an affidavit of heirship? An affidavit of heirship must be filed with the real property records in the county where the land is located. Call the county clerk and ask how much their filing fees are. The filing fees vary from county to county.
In obtaining an affidavit of heirship, it is desirable for the affiant to be a person related to the decedent but who does not inherit from the decedent. If none is available a person possessing personal knowledge of the decedent is the next choice. If neither is available, an interested heir can be used.
An affidavit of heirship can be used when someone dies without a will, and the estate consists mostly of real property titled in the deceaseds name. It is an affidavit used to identify the heirs to real property when the deceased died without a will (that is, intestate).
If you are named as an heir, you may have to prove to the estate trustee that you are the person named. This can be done by showing the estate trustee identification or providing an affidavit.
