How do I transfer a survivorship deed in Ohio? The surviving spouse must execute a simple Affidavit of Survivorship to memorialize the transfer. The affidavit, along with the deceased spouses death certificate, will then be recorded with the County Recorders Office to officially document that the transfer took place.
Fill out the affidavit completely. Sign the document in front of a notary. Attach a certified copy of the death certificate. Also attach a legal description of the property to be transferred (a copy of the survivorship deed or transfer on death designation or deed will suffice).
If you jointly own an asset with someone else, ownership of the joint asset will automatically transfer to the other person when you pass away. This is called a right of survivorship and means that property that is owned jointly will be transferred without the need for probate court oversight.
Ohio law provides that a deed must show a clear intention to create a survivorship tenancy.
