A Mechanics Lien is a hold placed on the title (ownership)of real estate by a contractor, material supplier, or other person who has improved the value of the property by performing work (e.g., carpentry) or supplying materials (e.g., lumber), but who has not been paid.
The potential lien claimant must record the mechanics lien within 90 days of: Completion of work, When the owner began using the improvement, or When the owner accepted the improvement. If the potential lien claimant fails to record the mechanics lien within the appropriate time frame, the lien isnt valid.
Step by Step Instructions Ask the claimant to release the lien. Obtain a certified copy of the lien. Copy and assemble the documents. File your documents, pay filing fee, and ask clerk for hearing date. Have the Petition and other documents served.
The lien claimant must file a lien foreclosure action within 90 days of the date that he or she recorded the mechanics lien. Often a lien claimant with a valid claim will fail to follow through, making the lien invalid.
Every mechanics lien in California must contain the owners name, a general description of the property and location, the name of the hiring party, a description of the work performed and the amount of money owed.
Going forward, Mechanics Lien (excluding the apostrophe) is the proper way to spell it.
If you have not been paid, a California mechanics lien must be enforced through a lien foreclosure action within 90 days from when the Claim of Lien has been filed. If no action is taken within 90 days, then the lien claim will expire and no longer be enforceable.
California law requires that a lawsuit be filed to foreclose on a mechanics lien within 90 days (Civil Code section 3144) after recording it.
