What is a secondment agreement? Well, its an agreement for a secondee. Well, thanks Simon, thats about as helpful as a hole in the head. Fair enough. Stick around and Ill tell you. Hi. Simon here from The Contract Company, Contracts for Australian Businesses. Thats what we do. All day, every day, and sometimes every night. Lucky us. I wasnt being flippant when I said, A secondment agreement is the agreement for a secondee. Well thats great. What is a secondee? Basically, its your employee. So if you run a business, and you have an employee, and you want to allow that employee to go and work at a client site for a period of time, then you would use a secondment agreement. Now the employee, even though theyre not physically based with you anymore, but theyre actually sitting with your client for that period of time, they are still your employee. You still have to pay them. They still accrue employee entitlements as a normal employee. Its just that the only thing thats differ

A secondment agreement is a legal contract that allows an employer to temporarily transfer an employee to another business location either within the company or to a separate organization. Secondment agreements are valuable for employees who would like to advance their skillset and professional development.
3.6 Secondment opportunities will not be unreasonably refused, or imposed on the employee. However if service needs dictate a secondment request may be declined (see Appendix 2 Secondment Process, Appendix 4 for Managers guidance notes, and Appendix 5 for draft response letter).
Disadvantages of Secondments Complete Twice the Administrative Work. Working in a secondment and keeping your regular job increases your litany of super-boring tasks. Attend Double the Meetings. Lack of Belonging. Miss Out on Changes in the Home Office. Steep Learning Curve.
Secondments will normally be limited to a maximum of 2 years after which the individual will be expected to return to their substantive post. Secondments should normally be granted provided they meet the following criteria: that the secondment will provide personal and professional development for the individual.
As a minimum, an effective secondment agreement should include: The length of the secondment. The nature of the seconded employees job role. The specific contractual obligations the seconded employee will be required to fulfil, and for whom.
Duration. A secondment is in essence a temporary arrangement and therefore typically the duration would not exceed 12 months (with an absolute maximum of 2 years). A secondment may be for as little as a few weeks and may be offered on a part-time basis, whilst the substantive post continues on a reduced basis.
Definitions. 5.1 Secondment. Secondment occurs when an employee is transferred temporarily from their substantive post to another post either in the same or another organisation and is expected to return to their old post at the end of the secondment.
Secondments should amount to a minimum of six months, and not exceed a period of two years.
. A secondment is an employment arrangement in which an employee receives an assignment to a new role either inside or outside a company. This new position provides opportunities for employees to learn new tasks, strengthen their skills and develop expertise outside of their job requirements.
A secondment does not terminate an employees contract of employment; the contract continues to subsist during the period of secondment, and a key principle of the arrangement is that the employee is expected to return to his or her substantive post when the secondment ends.
