Provided that the surname (or indeed first name) is not vulgar or offensive, parents can choose any name for their child. Traditionally, the child may have been given the fathers surname, but we are seeing more often mothers surnames, or indeed a combination of the two, either double-barrelled or amalgamated.
The law on family names An application to change a childs surname is normally only successful when everyone having parental responsibility for the child gives their written consent. They may agree to the name change or they may order a Specific Issue Order stating you cannot change the childs name.
Whether you are married or not, you dont have to give the baby the last name of either parent if you dont want to, and the child does not have to have the fathers last name to be considered legitimate. (See the article Legitimacy of Children Born to Unmarried Parents for more on the subject.)
This is a doctrine based on the patriarchal assumption that a fathers surname would deepen the family institution or provide children with more financial security later in life. Or, it is the easiest way to ensure the family names legacy.
In the case of an unmarried couple, whoever has custody of the child will be responsible for selecting the childs first and last name. This means that an unwed mother who has custody of the child may elect to give the child her last name or put the fathers last name on the birth certificate.
What should my parenting agreement contain? A parenting time schedule. Information about how the parents will make decisions for the child. Information about finances and expenses. Parenting provisions (rules about raising the child) Any other information you want to include.
In cases where the child is born out of wedlock, the child often gets the mothers last name. But if paternity is established, both parents have the right to petition the court to change the childs last name.
What name / surname can be given. Parents have can give their child whatever name or surname they want. Although its traditional to give a child the fathers surname, or, less commonly, the mothers surname, the childs surname could be a combination of both (for example) or something completely different.
