Social Security will waive overpayments of $50 or less. This is called the SSI $50 Rule. Where the overpayment is $1,000 or less and you file a request for reconsideration or waiver, Social Security will waive any collection of the over-payment (unless you were at fault in creating the overpayment).
Paying the money back If the over-payment was your fault, youll have to pay it all back. If a mistake was made with your payment, you may still be asked to pay it back, particularly if you could reasonably be expected to realise you were being overpaid.
If you do not wish to request a waiver, but you think we made a mistake when we decided that you were overpaid, or if you disagree with the amount of your overpayment. Instead, please complete the SSA-561, Request for Reconsideration. You are requesting a hearing before an Administrative Law Judge.
If you got a letter in the mail that says you were overpaid and need to pay us back, you can request a waiver. Ask us to waive repayment if you cant afford it and feel the error wasnt your fault, or if you believe the overpayment is unfair for another reason. We may ask to see details about your income and expenses.
If we decide you do not have to pay the money back, we call it a waiver. If you also think we made a mistake when we decided that you were overpaid, or if you disagree with the amount of your overpayment, please also complete the SSA-561, Request for Reconsideration. We call this action an appeal.
If you agree that you have been overpaid, but you feel you should not have to pay it back because you did not cause the overpayment and you cannot afford to repay it, you should file Form SSA-632, Request for Waiver of Overpayment Recovery.
