What if a landlord refuses to fix things? If a landlord is failing to fix basic things such as leaky taps or broken toilet seats within a reasonable time (two weeks) then the best thing tenants can do is bombard them with requests and remind them that they could be in bdocHub of the tenancy agreement.
To lawfully withhold rent in California, the property condition must violate the general warranty of habitability, and the landlord must be beyond the reasonable repair time. For example, if the rental property is in need of a critical repair, such as fixing the heat, a landlord must fix it within 24 hours. When it comes to non-critical emergencies, a landlord has 14 days to make the repair.
Your landlord has up to 30 days to make requested repairs. Emergency repairs (like no heat in the winter) must be finished faster. Be current on rent payments.
This does not mean that either your landlord or contractors should just let themselves in. Legally, your landlord would have to apply for a court order to get access. You could be at risk of section 21 eviction if you rent privately and refuse access for repairs or gas or electrical safety checks.
