Under California law, the only lawful way to evict a tenant is to file a case in court. As a tenant, you have a right to remain in your home until a court orders you to move out.
If your tenant wont fix the problem or move out, youll have to go through the court to get an order for them to move out. The eviction process can take 30 - 45 days, or longer. The time starts from when you have eviction court forms delivered to your tenant to the time they must move out.
Any property of the tenant left on the premises will be turned over to the landlord for storage. After the eviction is completed, the Sheriff will provide the landlord with a receipt for possession and send the writ together the Sheriffs return to the issuing court. A proof of service is not issued.
The notice being served establishes the time frame in which the process will proceed. If tenants are served with a 3 Day Notice to Pay or Vacate, and if they dont pay, the eviction process in California can start on the 4th day. If they are doing criminal activity a 3 Day Notice to Vacate is also served.
In California, landlords must file a 60 or 30-day notice to vacate letter before moving forward with an eviction. The notice of termination gives their tenant time to move out or deal with a dispute. If the tenant doesnt vacate the property after this time, landlords may start the eviction process.
3-day Notice to Perform Covenants or Quit (Fix a problem or move out) A landlord can use this kind of Notice if their tenant isnt following the rental agreement or lease, and the problem can be fixed.
If you get a 30 or 60-day Notices to Quit, it must be in writing and include: The tenant(s) full name(s) The rental homes address. That the month-to-month tenancy will end in 30 days if theyre giving a 30-day Notice or in 60 days if theyre giving a 60-day Notice.

The only way to legally evict a tenant is by filing a lawsuit. As a landlord, you can remove tenants who violate their lease agreements. California calls eviction lawsuits unlawful detainer actions, and you should expect the entire eviction process in CA to take about one month.
After the Writ of Execution has been served to the tenants, they will be given a grace period of 5 days to vacate the property. The sheriff will execute the eviction and forcibly remove them if they remain in the property after the grace period given to them.
