Right of survivorship This right, also known as ius accrescendi, provides that upon the death of any of the joint tenants, the entire co-owned estate is said to survive to the living joint tenant(s). The rights of the joint tenant upon death are therefore entirely extinguished upon death.
Property owned jointly with rights of survivorship is treated very much like property owned with multiple beneficiaries. The difference is often in the distribution to remaining owners if one has died. Unless percentage ownership of specific shares is spelled out, only the surviving owners will inherit the property.
What is the right of survivorship? The right of survivorship is the legal principle which dictates that the shares of joint tenant owners passes automatically to the surviving joint owners on the death of others. This overrides the terms of any will and the rules of intestacy.
However, one feature a tenancy in common does not have is a right of survivorship. Generally speaking, if there are multiple tenants in common and one owner dies, that deceased owners interest passes to his or her heirs.
The right of survivorship means that on the death of one co-owner, that co-owners interest in the property will pass automatically to the surviving co-owner(s) by law. This means that you cannot leave your share of a property that you own as joint tenants to someone in your Will.
Normally when property is purchased jointly there is a survivorship clause, meaning that on the death of one of the joint owners, their share in the property automatically passes to the survivor(s).
If one of two owners of property held in a JTWROS dies, ownership is transferred automatically to the remaining owner. This is called a right of survivorship. Unlike a tenancy in common, a co-owner cannot transfer their interest in property owned subject to a right of survivorship without destroying the right.
A right of survivorship is created by special language in the deed. In the case of joint tenancy with right of survivorship, the deed may list the owners and state that the property is held as joint tenants with right of survivorship.
