A quitclaim deed removes the name of one owner from the deed, while a gift deed is used to transfer a property from one owner to another.
The only way to change a recorded deed is to have a new deed prepared and recorded in the Clerks Land Records Office. The deed on record cannot be changed. Once a document is recorded, it cannot be changed.
Any gift of immovable property cant divest any title in the donee unless and until the gift is duly registered. A gift deed needs to be registered in a manner prescribed by the Registration Act of 1908.
Deeds of gift are exempt from recordation taxes under Va. Code 58.1-811(D). The deed must state on its face that the transfer is exempt from the tax. Virginia does not levy a state gift tax, but the grantor must pay the Federal Gift Tax.
Both parties should mention all relevant information like address, name, date of birth and signature. A gift deed should have two witnesses and their signatures. A gift deed should be printed on stamp paper once the amount is paid. Once that is done, it should be registered at the registrars or sub-registrars office.
You make a gift if you give property (including money), or the use of or income from property, without expecting to receive something of at least equal value in return. If you sell something at less than its full value or if you make an interest-free or reduced-interest loan, you may be making a gift.
A gift deed must be (1) in writing, (2) signed, (3) describe the property, and (4) delivered. TPC 5.021. Texas further requires the document set forth (1) the intent of the grantor, (2) the delivery of the property to the grantee, and (3) the gift to be accepted by the grantee.
If a deed doesnt immediately transfer the property or meet any of the necessary requirements, it can be revoked.
Any ambiguity or reference to consideration can make the deed contestable in court. A promise to transfer ownership in the future is not a gift, and any deed that does not immediately transfer the interest in the property, or meet any of the aforementioned requirements, can be revoked.
