When you are off sick you continue to accrue annual leave. You will not accrue bank holiday leave unless this would take you below your statutory leave entitlement of 5.6 weeks per year.
Theres no legal reason why a sick day cant be converted to a day of annual leave. But its the companys decision whether to allow this or not. In the employees favour, it can work to reduce their amount of sick days on record.
Sick leave can include a mental health day and taking time away from work to go to a scheduled doctors appointment. Some policies also allow paid sick time to be used to care for sick family members, or to address health and safety needs related to domestic violence or sexual assault.
Sick leave and holiday Any statutory holiday entitlement that is not used because of illness can be carried over into the next leave year. If an employee is ill just before or during their holiday, they can take it as sick leave instead. An employee can ask to take their paid holiday for the time theyre off work sick.
Depending on how many hours you work a day, this is roughly 27 days of holiday (plus eight bank holidays). However, employees who have worked within the service for five years get 29 days of holidays and eight bank holidays.
Click New, then select Statutory leave. Select the employee, then select Sick. Enter the start and end dates. Once you enter the leave period, Xero displays the number of waiting days and qualifying days applied to this leave.
If you are off sick, your employment status will always be off sick until you are fit to return to work. However, if you and your manager agree, you can be paid for your annual leave at the same time as you are off sick.
What should a sick policy include? A sick policy should include, as an absolute minimum, the reporting procedures, the rules relating to sick notes and pay, the expectations on keeping in touch, what support services are available and how back-to-work interviews will be conducted.
A record of every sickness instance should be made, to include the date of notification of absence, the reason for it by reference to the standard definitions as per the Sickness Absence Record form (on the right-hand side of the page) and later, the date the employee returned to work.
