A Declaration of Domicile proves residency in Broward County, Florida. It is often used to enroll children or college students in school, to establish eligibility for Homestead Exemption, or as the first step toward establishing legal residence in Florida.
A decedent can be domiciled in the U.S. for estate and gift tax purposes if they lived in the U.S. and had no present intention of leaving.
Acceptable forms of identification include: an identification card or drivers license issued by the Department of Highway Safety and Motor Vehicles; or a passport issued by the Department of State of the United States. Other acceptable forms of Identification are described in Chapter 117 of the Florida Statutes.
Completing the Form Line 1 - Fill in the last address you lived at before you moved to the state of Florida/or if within Florida, your previous address. Line 2 - Fill in the date you moved to Florida. Line 3 - Fill in your current address. Line 4 - Your signature. Line 5 - Clearly and legibly PRINT the name that you signed.
Florida Statute 222.17 states that a person can show intent to maintain a Florida residence as a permanent home by filing a sworn Declaration of Domicile with the Clerk of the Courts. You can submit the form with all the requirements by mail or in person at Miami-Dade County Courthouse East.
This affidavit is made for the purpose of securing the transfer or delivery of property owned at the time of the decedents death to a purchaser or the person(s) legally entitled thereto under the laws of the state of the decedents domicile.
I now reside at (street address) Leon County, Florida and this statement is to be taken as my declaration of actual legal residence and permanent domicile in this State and County to the exclusion of all others, and I will comply with all requirements of legal residents of Florida.
The place where you live with the intent of making it your permanent residence is your domicile. You cannot have more than one, and you must spend a greater percentage of the year in your declared state than anywhere else. This also involves terminating your legal residence in a former state.
