For extended leave, a leave of absence agreement should include both the start date and the anticipated end date of the leave. If the leave length is uncertain, such as when dealing with a health condition, the end date should still be included, along with any language detailing extensions.
Q: Does the law guarantee paid time off? No. The FMLA only requires unpaid leave. However, the law permits an employee to elect, or the employer to require the employee, to use accrued paid vacation leave or, subject to certain restrictions, sick or family leave, for some or all of the FMLA leave period.

An FMLA leave allows employees to take up to 12 weeks off in a 12-month period. If their absence is not protected by the Family and Medical Leave Act (FMLA), then its considered a non-FMLA medical leave. However, their leave may still be protected under the ADA and ADA Amendments Act (ADAAA).
