Basically, what you can come up with and what is required by the courts as far as a parenting plan? People have asked me whats required. Like how much detail does the court need as far as a custom plan? Heres the answer. The courts do not need a detailed parenting plan at all. All they need to know is how you are going to label your custody. Meaning, are you going to have joint legal and joint physical or is one party going to be the sole physical custodial parent etc.? You dont need an actual detail plan. For people who want to have an open parenting plan and not a specified plan, you can simply say joint legal, joint physical, and reasonable right of visitation to the other party. Arizona law recognizes three levels of child custody: sole custody, joint custody, and in loco parentis. You may also see the term legal decision making instead of child custody, as this is Arizonas preferred term to describe custody, as it more accurately describes the parents roles.
While no law permits the child to choose their custody status, most California courts believe 14 years of age is old enough to express themselves and the reasons why they prefer one parent over the other.
In California, the law allows children age 14 and up to express their parental preference to aid in determining custody. However, no matter the childs age, a judge will consider their preference in evaluating the overall suitability of the custody arrangement.
Dads are not automatically entitled 50-50 custody, or any custody order for that matter. Likewise, there is nothing in the family code that automatically grants custody to fathers solely on the basis that they are the dad. The standard the court uses during a divorce is the best interest of the child.
However, their wishes and feelings and any decision you make may not be legally binding. As a child cannot legally decide who they want to live with until they are 16, the responsibility for this decision usually rests with the parents.
Generally, you can move with the children so long as the relocation doesnt interfere with your current custody arrangement. For courts, thats usually limited to a distance of 50 miles or less. (However, even a move 30 miles away could be disruptive depending on the circumstances.)
